This website is operated by NightyDress.pk. Throughout the site, the terms “we”, “us” and “our” refer to NightyDress.pk. We offer this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including the additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, customers and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to all of them, you may not access the website, purchase any product or use any services.

Any new features or tools added to the online store are also subject to these Terms. We may update, change or replace any part of these Terms by posting changes on this page. It is your responsibility to check this page from time to time. Your continued use of the website after changes are posted means you accept them.

SECTION 1 – GENERAL CONDITIONS

  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the website, the Service or its content without our express written permission.
  • The headings in this agreement are for convenience only and do not limit or affect these Terms.

SECTION 2 – ONLINE STORE TERMS

  • We may limit the sale of our products to any person, region or jurisdiction, and may limit the quantities we offer.
  • We may refuse, limit or cancel any order. This can include orders placed under the same account or the same billing or shipping address, and orders that appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we may try to contact you by the email or phone number given at the time of the order.
  • You agree to give current, complete and accurate information for all purchases, and to update your email, address and phone number promptly so we can process your order and contact you.
  • You understand that your information can be shared with our partners, including sharing your address and phone number with our courier and logistics partners and service providers who help us run the store.
  • Products may be available in limited quantities and are subject to return or exchange only under our Return Policy.
  • You may not use our products for any illegal or unauthorized purpose, or break any law in your jurisdiction (including copyright laws).
  • We may block access to the website from any IP address used for fake orders, spam or abuse. If you are blocked by mistake, email us at order@nightydress.pk.

SECTION 3 – PAYMENTS & ORDER PROCESSING

  • We accept Cash on Delivery and bank transfer.
  • With Cash on Delivery, the Rs 250 delivery charge is paid in advance by bank transfer, and the rest of the order amount is paid in cash on delivery. With Direct bank transfer, the full amount is paid in advance. Orders are dispatched only after the advance is received.
  • If our courier does not cover your area, the full order amount must be paid in advance and the order is sent with another courier.
  • We confirm orders before dispatch. We will try to reach you three times; after that, the order is cancelled.
  • If we can’t dispatch to your area for any reason, we will tell you by email or phone.
  • You can cancel your order before it is dispatched. Once it has been dispatched, it can’t be cancelled.

SECTION 4 – SHIPMENT & ORDER TRACKING

  • All orders are dispatched through our courier partners.
  • Delivery takes up to 3 working days in Karachi, up to 7 working days in major cities and up to 10 working days in remote areas. Full details are on our Shipping & Delivery page.
  • If the courier can’t reach you on the first try, they will call you and try again within 24 hours. After the second try, the courier keeps the parcel for 3 days before returning it to us, and the order is cancelled.
  • The parcel is handed over once the remaining amount is paid to the courier.
  • Every parcel is checked before it leaves us. If something arrives damaged or faulty, follow our Return & Exchange policy, or email order@nightydress.pk.

  • We try to show the colors and images of our products as accurately as possible. We cannot guarantee that your device display of any color will be accurate.
  • Product descriptions and prices can change at any time without notice. We may discontinue any product at any time.
  • We do not warrant that any product, service or information you obtain from us will meet your expectations, or that any errors in the Service will be corrected.
  • We are not liable to you or any third party for any modification, price change, suspension or discontinuance of a product or the Service.
  • Because of currency changes in Pakistan, product availability and prices may vary.

SECTION 7 – THIRD PARTY SERVICES

  • Some tools and content on our website may come from third parties.
  • Third-party links on this site may lead to websites that are not connected to us. We are not responsible for the content or accuracy of any third-party websites, materials or services.
  • We provide such tools and services “as is” and “as available”, without any warranty or endorsement, and we have no liability arising from your use of them. You use them at your own risk, and should read the terms of the third-party provider first.
  • Complaints or questions about third-party products or services should be sent to the third party.

SECTION 8 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

  • If you send us comments, ideas, suggestions or other materials (including reviews), you agree that we may edit, copy, publish, distribute, translate and use them in any medium without restriction. We have no duty to keep them confidential, pay for them or respond to them.
  • We may, but need not, monitor, edit or remove content that we judge to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that breaks these Terms or anyone’s intellectual property rights.
  • You agree that your comments will not violate any right of a third party, and will not contain unlawful, abusive or obscene material or any virus or malware. You may not use a false email address or pretend to be someone else. You are solely responsible for your comments and their accuracy. We take no responsibility for comments posted by you or any third party.

SECTION 9 – ERRORS, INACCURACIES AND TIMELINESS OF INFORMATION

  • Our site may sometimes contain typing errors, inaccuracies or omissions about product descriptions, prices, offers, shipping charges, delivery times and availability. We may correct them, update information or cancel orders if information is inaccurate, at any time and without notice (including after you have placed your order).
  • We have no duty to update or clarify information on our site, except as required by law. No update or refresh date shown on the site means all information has been updated.

SECTION 10 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

  • We do not guarantee that your use of our online store will be uninterrupted, timely, secure or error-free.
  • We may remove or cancel the service for any period of time, at any time, without notice to you.
  • In no case are we, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind (including lost profits, lost revenue, lost savings, loss of data or replacement costs), whether in contract, tort (including negligence), strict liability or otherwise, arising from your use of the service or any product bought through it, even if we were told they were possible.

SECTION 11 – ENTIRE AGREEMENT

  • These Terms and any separate agreements under which we provide you Services are governed by the laws of the Islamic Republic of Pakistan.
  • If we do not exercise or enforce a right or provision of these Terms, that is not a waiver of it.
  • Any ambiguity in these Terms will not be read against the party that drafted them.
